For the purposes of the Data Privacy Act of 2012, 5mbw is the personal information controller in respect of the personal data collected through the Platform. As the personal information controller, 5mbw determines the purposes and means of processing your personal data and is responsible for ensuring that such processing complies with applicable Philippine data privacy laws.

7. DATA SHARING AND DISCLOSURE

• Payment Processors: GCash, PayMaya, BPI, BDO, Metrobank, and other payment service providers, for the purpose of processing your financial transactions.

• Fraud Prevention and Security Services: Providers of fraud detection, anti-money laundering screening, and cybersecurity services.

• Technology Service Providers: Cloud hosting providers, IT infrastructure providers, and software vendors who process data on our behalf under strict data processing agreements.
• Law Enforcement: Philippine law enforcement agencies, where disclosure is required by a valid court order, subpoena, or other legal process.

All third parties with whom 5mbw shares personal data are required to handle such data in accordance with applicable data privacy laws and are prohibited from using your data for any purpose other than the specific purpose for which it was shared.

8. DATA RETENTION

5mbw retains your personal data only for as long as necessary to fulfill the purposes for which it was collected, or as required by applicable Philippine law and regulation. The following general retention periods apply:

• Account Data: Retained for the duration of your active account relationship with 5mbw, and for a period of five (5) years following account closure, in compliance with PAGCOR and AMLC record-keeping requirements.
• Financial Transaction Records: Retained for a minimum of five (5) years from the date of the transaction, as required by the Anti-Money Laundering Act of the Philippines.
• KYC and Identity Verification Documents: Retained for a minimum of five (5) years following account closure or the completion of the relevant transaction.
• Communications Data: Support communications and correspondence are retained for up to three (3) years from the date of the communication.
• Technical and Usage Data: Retained for up to two (2) years from the date of collection, unless a longer retention period is required for security or legal purposes.

Upon expiry of the applicable retention period, personal data will be securely deleted or anonymized in accordance with 5mbw's data disposal procedures.

9. DATA SECURITY

5mbw implements appropriate technical and organizational security measures to protect your personal data against unauthorized access, accidental loss, destruction, alteration, or disclosure. These measures include:

While 5mbw takes all reasonable steps to protect your data, no method of transmission over the internet or electronic storage is 100% secure. You are responsible for maintaining the security of your 5mbw account credentials.

10. COOKIES AND TRACKING TECHNOLOGIES

5mbw uses cookies and similar tracking technologies to enhance your experience on the Platform, analyze usage patterns, and support security functions. The following types of cookies are used:

• Strictly Necessary Cookies: Essential for the Platform to function correctly. These include session cookies that keep you logged in and security cookies that protect against fraud. These cannot be disabled.

12. MINORS AND AGE RESTRICTION

The 5mbw Platform is strictly intended for individuals who are 21 years of age or older, in accordance with Philippine regulations governing casino-style online gaming. 5mbw does not knowingly collect personal data from individuals under the age of 21.

If 5mbw becomes aware that personal data has been collected from a person under 21 years of age, we will take immediate steps to delete such data and close the associated account. If you believe that a minor has registered on the 5mbw Platform, please contact us immediately using the details in Section 15.

Age verification is a mandatory part of the 5mbw registration and KYC process. 5mbw reserves the right to request documentary proof of age at any time and to suspend accounts pending age verification.

5mbw reserves the right to update or amend this Privacy Policy at any time to reflect changes in our data processing practices, legal requirements, or Platform features. When material changes are made, 5mbw will notify registered players by email or through a prominent notice on the Platform prior to the changes taking effect.

The updated Policy will display a revised "Last Updated" date at the top of this page. Your continued use of the 5mbw Platform following the posting of an updated Policy constitutes your acceptance of the changes.
