1. INTRODUCTION

Welcome to 5mbw. These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Player," "User," or "you") and 5mbw ("5mbw," "we," "us," or "our") governing your access to and use of the 5mbw online gaming platform, including all games, features, promotions, and services made available through the website at https://5mbw.net and the 5mbw mobile application (collectively, the "Platform").

By creating a 5mbw account, accessing the Platform, or placing any wager, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety, together with our Privacy Policy and Responsible Gaming Policy, which are incorporated herein by reference. If you do not agree to these Terms, you must not use the 5mbw Platform.

5mbw operates within the regulatory framework established by the Philippine Amusement and Gaming Corporation (PAGCOR). These Terms are designed to comply with applicable Philippine laws and regulations governing online gaming.

2. ELIGIBILITY

To register and use the 5mbw Platform, you must satisfy all of the following eligibility requirements:

• You must be at least 21 years of age. This is a strict legal requirement under Philippine regulations applicable to casino-style gaming. 5mbw does not permit access to persons under 21 years of age under any circumstances.
• You must be physically located in a jurisdiction where online gaming is lawful at the time of play. It is your sole responsibility to ensure that your use of 5mbw complies with the laws of your jurisdiction.
• You must not be a current employee, contractor, director, officer, or agent of 5mbw, or an immediate family member of any such person.
• You must not be listed on any self-exclusion register maintained by PAGCOR or any other recognized gaming authority.
• You must have full legal capacity to enter into a binding contract under Philippine law.

5mbw reserves the right to request documentary proof of age and identity at any time. Failure to provide satisfactory verification may result in suspension or permanent closure of your account and forfeiture of any balance held therein.

3. ACCOUNT REGISTRATION

To access the full features of the 5mbw Platform, you must register a player account. The following rules apply to account registration and maintenance:

• One Account Per Person: Each individual may hold only one active 5mbw account. The creation of multiple accounts by a single individual is strictly prohibited and will result in the suspension of all associated accounts.
• Accurate Information: You must provide accurate, complete, and current information during registration, including your full legal name, date of birth, residential address, and valid contact details. You must promptly update your account information if any details change.
• Account Security: You are solely responsible for maintaining the confidentiality of your username and password. You must not share your login credentials with any third party. All activity conducted through your account will be attributed to you.
• Notification of Unauthorized Access: You must notify 5mbw immediately upon becoming aware of any unauthorized use of your account or any breach of security. 5mbw will not be liable for any loss arising from unauthorized use of your account prior to such notification.
• Account Verification: 5mbw may require you to complete a Know Your Customer (KYC) verification process before processing withdrawals or at any other time deemed necessary. Required documents may include a government-issued photo ID, proof of address, and proof of payment method ownership.

5mbw reserves the right to refuse account registration to any applicant at its sole discretion, without obligation to provide a reason.

4. DEPOSITS & WITHDRAWALS

All financial transactions on the 5mbw Platform are subject to the following terms:

• Accepted Payment Methods: 5mbw accepts deposits and processes withdrawals via GCash, PayMaya, BPI, BDO, Metrobank, and other payment methods as listed on the Platform from time to time. Accepted methods may change without prior notice.
• Own Funds Only: You may only deposit funds from payment accounts registered in your own name. Third-party deposits are strictly prohibited. Any deposit identified as originating from a third party will be reversed and the associated account may be suspended.
• Minimum and Maximum Limits: Deposits and withdrawals are subject to minimum and maximum transaction limits as displayed on the Platform. These limits may vary by payment method and account verification status.
• Withdrawal Processing: Withdrawal requests are processed subject to completion of KYC verification. 5mbw aims to process GCash and PayMaya withdrawals within 15 minutes during business hours. Bank transfers to BPI, BDO, and Metrobank are typically processed within the same business day. Processing times are estimates and not guaranteed.
• Currency: All transactions on 5mbw are denominated in Philippine Peso (₱ / PHP). Currency conversion fees, if any, are the responsibility of the Player.
• Anti-Money Laundering: 5mbw is committed to compliance with Philippine anti-money laundering laws. We reserve the right to conduct enhanced due diligence on any transaction and to report suspicious activity to the appropriate Philippine authorities, including the Anti-Money Laundering Council (AMLC).
• Dormant Accounts: Accounts with no login activity for a period of 12 consecutive months may be classified as dormant. 5mbw reserves the right to apply an administrative fee to dormant accounts in accordance with applicable regulations. Players will be notified before any fee is applied.

5. BONUSES & PROMOTIONS

5mbw offers various bonuses and promotional offers to eligible players. All bonuses are subject to the following general terms, in addition to any specific terms attached to individual promotions:

• Bonuses are available to eligible registered players only. 5mbw reserves the right to determine eligibility at its sole discretion.
• All bonuses are subject to wagering requirements. The applicable wagering requirement will be clearly stated in the specific promotion terms. Bonus funds and any winnings derived therefrom cannot be withdrawn until the wagering requirement has been fully satisfied.
• Only one bonus may be active at a time unless otherwise specified in the promotion terms.
• Bonuses are non-transferable and have no cash value until wagering requirements are met.
• 5mbw reserves the right to withdraw, modify, or cancel any bonus or promotion at any time. Where a bonus is cancelled, any wagering requirement attached to that bonus will be voided and any bonus-derived balance will be removed from the account.
• Any attempt to abuse, exploit, or circumvent bonus terms — including through the use of multiple accounts, collusion, or systematic betting strategies designed to exploit bonus conditions — will result in immediate account suspension and forfeiture of all bonus funds and associated winnings.
• 5mbw's decision on all bonus-related matters is final and binding.

6. GAMEPLAY RULES

The following rules apply to all gaming activity on the 5mbw Platform:

• Game Rules: Each game available on 5mbw is governed by its own specific rules, which are accessible within the game interface. It is your responsibility to familiarize yourself with the rules of any game before placing a wager.
• Minimum and Maximum Bets: Each game has minimum and maximum bet limits as displayed within the game. These limits may be adjusted by 5mbw at any time without prior notice.
• Malfunctions: In the event of a technical malfunction, game error, or system failure, 5mbw reserves the right to void affected bets and refund the wagered amount to the Player's account. 5mbw's decision regarding the outcome of any disputed game round is final.
• Disconnection: 5mbw is not responsible for losses incurred as a result of internet disconnection, device failure, or any other technical issue on the Player's end. Where a game round is interrupted due to disconnection, the round will be resolved according to the game's standard rules upon reconnection.
• Obvious Errors: In the event of an obvious error in odds, payouts, or game outcomes — including typographical errors — 5mbw reserves the right to void affected transactions and correct the error. Winnings paid out as a result of an obvious error may be reclaimed by 5mbw.
• RNG Certification: All random number generator (RNG) based games on 5mbw use certified RNG technology. Game outcomes are determined independently and cannot be influenced by 5mbw or any third party.

7. PROHIBITED CONDUCT

The following conduct is strictly prohibited on the 5mbw Platform. Violation of any of these prohibitions may result in immediate account suspension, permanent ban, forfeiture of all funds, and referral to Philippine law enforcement authorities:

• Registering more than one account, or registering on behalf of another person without their explicit consent.
• Providing false, misleading, or fraudulent information during registration or at any other time.
• Using automated software, bots, scripts, or any other artificial means to interact with the Platform or gain an unfair advantage in any game.
• Colluding with other players to manipulate game outcomes or exploit bonus offers.
• Engaging in any form of money laundering, including using the Platform to process funds derived from illegal activity.
• Attempting to hack, reverse-engineer, or otherwise compromise the security or integrity of the 5mbw Platform.
• Harassing, threatening, or abusing 5mbw staff or other players through any communication channel.
• Using the Platform for any purpose other than personal entertainment gaming.
• Accessing the Platform from a jurisdiction where online gaming is prohibited by law.

8. INTELLECTUAL PROPERTY

All content on the 5mbw Platform — including but not limited to the 5mbw brand name, logo, website design, graphics, game interfaces, software, text, and promotional materials — is the exclusive intellectual property of 5mbw or its licensors and is protected by applicable Philippine and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for your personal, non-commercial entertainment purposes. This licence does not permit you to copy, reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from the Platform without the prior written consent of 5mbw.

Any unauthorized use of 5mbw's intellectual property may result in legal action.

9. PRIVACY & DATA

5mbw collects, processes, and stores personal data in accordance with our Privacy Policy, which forms part of these Terms. By using the Platform, you consent to the collection and processing of your personal data as described in the Privacy Policy.

5mbw complies with the Republic Act No. 10173, also known as the Data Privacy Act of 2012 of the Philippines. Your personal data will not be sold to third parties. It may be shared with regulatory authorities, payment processors, and identity verification providers as necessary to operate the Platform and comply with legal obligations.

10. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable Philippine law, 5mbw's total liability to you for any claim arising out of or in connection with your use of the Platform shall not exceed the total amount deposited by you into your 5mbw account in the 30 days preceding the event giving rise to the claim.

5mbw shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or loss of goodwill, arising out of or in connection with your use of the Platform, even if 5mbw has been advised of the possibility of such damages.

5mbw does not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components. You access and use the Platform at your own risk.

Gambling involves financial risk. 5mbw is not responsible for any financial losses you incur through gaming activity on the Platform. You are solely responsible for your gaming decisions and the management of your gaming budget.

11. TERMINATION & ACCOUNT CLOSURE

5mbw reserves the right to suspend or permanently close your account at any time, with or without prior notice, for any of the following reasons:

• Breach of any provision of these Terms.
• Failure to satisfy eligibility requirements, including age verification.
• Suspected fraudulent, illegal, or abusive activity.
• Request by a regulatory authority or law enforcement agency.
• Failure to complete KYC verification within a reasonable timeframe.

Upon account closure for breach of these Terms, 5mbw reserves the right to forfeit any balance remaining in the account. Where an account is closed for reasons other than breach — including voluntary closure by the Player — any verified balance will be returned to the Player via their registered payment method, subject to completion of any applicable verification requirements.

12. GOVERNING LAW & DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.

In the event of any dispute arising out of or in connection with these Terms or your use of the 5mbw Platform, you agree to first contact 5mbw support to seek an informal resolution. 5mbw will endeavor to resolve all disputes within 30 days of receiving a formal written complaint.

If a dispute cannot be resolved informally, it shall be submitted to the exclusive jurisdiction of the appropriate courts of the Philippines. You waive any right to participate in a class action lawsuit or class-wide arbitration against 5mbw.

5mbw's decisions on all gaming-related disputes — including game outcomes, bonus eligibility, and account status — are final and binding, subject to applicable regulatory oversight by PAGCOR.

13. AMENDMENTS TO THESE TERMS

5mbw reserves the right to amend, update, or replace these Terms at any time. When material changes are made, 5mbw will notify registered players via email or a prominent notice on the Platform. The updated Terms will display a revised "Last Updated" date at the top of this page.

Your continued use of the 5mbw Platform following the posting of updated Terms constitutes your acceptance of those changes. If you do not agree to the updated Terms, you must cease using the Platform and may request account closure.

It is your responsibility to review these Terms periodically to stay informed of any updates.
